Terms of Use for Pixify AI

Welcome to Pixify AI ("App"), an AI-powered image editing application published by Behçet Kutay Zeki ("Developer"), available on iOS and accessible via nexgenapps.xyz/pixify ("Website").

These Terms of Use ("Terms") govern your use of the App. By downloading, installing, or using the App, you agree to these Terms and Apple's Licensed Application End User License Agreement ("Standard EULA") where applicable. If you do not agree, please do not use the App.

1. Use of the App

Pixify AI allows users to generate and edit images using artificial intelligence tools. You may use the App for personal, non-commercial purposes, subject to these Terms.

You agree not to:

• Violate any laws or regulations.
• Upload, submit, or generate content that is unlawful, offensive, harmful, or infringing.
• Reverse engineer, decompile, or otherwise attempt to access source code.
• Interfere with or attempt to disrupt the App or its servers.

2. Subscriptions and In-App Purchases

Pixify AI may offer auto-renewable subscriptions and other in-app purchases processed via Apple's App Store.

• Payments, renewals, and cancellations are managed through your Apple ID account settings.
• You are responsible for managing your subscription preferences.
• Refunds must follow Apple's policies, not the Developer's.
• Pricing and feature access may vary by region or promotion.

3. AI Image Processing

When you upload content for processing:

• Images are used only for temporary AI generation and are not stored.
• We do not claim ownership over your content.
• You must have legal rights to any image you upload.

4. Intellectual Property

• All App content (e.g., UI, branding, designs, software) belongs to the Developer or its licensors.
• You may not copy, modify, distribute, or create derivative works without written permission.

5. External Services

The App may allow access to third-party APIs or services (e.g., OpenAI). You use these at your own risk.

We are not responsible for the accuracy, availability, or safety of third-party services. Usage may be subject to additional terms from those providers.

6. Termination

We reserve the right to suspend or terminate your access if you violate these Terms or misuse the App.

You may delete the App at any time to terminate your agreement.

7. Consent to Data Use

We may collect non-personally identifiable technical information (e.g., device type, iOS version) to improve app performance, analytics, and support. No personal images or content are stored without consent.

8. NO WARRANTY

• That the App will be uninterrupted or error-free
• That AI-generated content will meet expectations
• That content is suitable for your specific purposes

Some jurisdictions may not allow the exclusion of implied warranties, so these disclaimers may not apply to you.

• The Developer is not liable for any indirect, incidental, or consequential damages, including loss of data, revenue, or use.
